OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT IMPROVE CHANCES OF WINNING. THE FOLLOWING
CONTEST IS OPEN TO LEGAL RESIDENTS OF THE (50) UNITED STATES (the “U.S.”) AND DISTRICT OF COLUMBIA (“D.C.”) ONLY,
WHO MEET THE ELIGIBILITY REQUIREMENTS (AS DEFINED IN THE RULES BELOW). VOID ELSEWHERE AND WHERE
PROHIBITED BY LAW.
Contest Period: Contest is scheduled to begin on 9/29/08, and end on 10/24/08 (the “Contest Period”). Contest attempts will be executed Monday through Friday during the Contest Period at the designated times announced on air as determined by sponsor. The contest is subject to all applicable federal, state and local laws and regulations and is void outside the U.S. and D.C. and where prohibited.
Who May Enter: Contest is open to legal residents of the U.S. and D.C., who are age 18 or older as of date of entry, and have a valid U.S. driver’s license, state issued ID card and Social Security number except the following persons who are not eligible to participate or win:
a. Employees, officers, and directors of KMTK-FM (“Sponsor”), each of their respective franchisees, parents, affiliated companies, subsidiaries, distributors, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of this promotion (collectively, “Released Parties”), and the members of the immediate families or households, whether or not related, of any of the above. “Immediate family members” includes, for purposes of this promotion, parents (including in-laws), grandparents, siblings (including step-siblings), children (including step-children), grand children (including step grand children) and each of their respective spouses.
b. Any persons not in possession of a valid U.S. driver’s license at the time of the contest attempt.
How to Enter: At selected times during the contest period, KMTK-FM will announce the contest and instruct listeners to be the correct caller taken to participate in the contest. Listen to KMTK-FM for the designated instructions to call the station to participate in the contest, and be the randomly selected (9th) caller taken by the station to participate in the contest.
Finalist Selection: A maximum of one (1) contestant will be randomly selected to participate in each scheduled contest attempt. There will be a total of (60) individual contest attempts during the entire contest period. Contestants may participate in the contest a maximum of one (1) time during the entire length of the promotion. Any additional attempts by a contestant will automatically be void.
The (9th) caller randomly taken by the contest administrator, who meets all the eligibility requirements, will be eligible to participate in that particular contest attempt. If any selected caller does not meet the eligibility requirements, is not in possession of a valid U.S. Driver’s License or does not wish to participate in the contest, then that caller will be disqualified. Sponsor will then select an alternate contestant to participate in that particular contest attempt by randomly selecting the next
caller. This process will continue until an eligible contestant is identified. Decisions of the contest administrator in determining the correct caller and identifying an eligible contestant for each contest attempt are final and binding in all matters relating to this contest. Any difficulties with phone lines or busy signals that prevent entry or participation in the contest are not the responsibility of the Sponsor.
Grand Prize Contest: Each eligible contestant will be required to participate in the contest using their own most recently issued valid U.S. Driver’s License. A randomly selected winning 5-digit number will be predetermined and assigned to each contest attempt by an independent contest administrator. Each randomly selected winning 5-digit number will be placed in a sealed envelope, and labeled with its corresponding contest attempt. Following the selection of the eligible contestant, each contest attempt will proceed as follows:
· The contestant will be required to identify their name and address as listed on their driver’s license along with their phone number, date of birth and the state which issued their driver’s license;
· The contest administrator will confirm the contestant is currently in possession of their most recently issued valid U.S. Driver’s License;
· The contest administrator will then open the sealed envelope assigned to that particular contest attempt, and announce the enclosed 5-digit winning number to the contestant;
· If the last 5-numeric digits of the contestant valid U.S. driver’s license match in exact order with the winning 5-digit number contained in the sealed envelope, then that contestant will be eligible to claim the grand prize, subject to compliance with and verification of all requirements of these official rules.
§ If the winning 5-digit number contained in the sealed envelope is not an exact match in order with the last 5-numeric digits of the contestant’s driver’s license number, then that contestant will not be eligible to claim the grand prize.
· If the 5th, 4th, 3rd, and 2nd to last digits of the contestant valid U.S. driver’s license match in exact order with the winning first 4-digit number contained in the sealed envelope, then that contestant will be eligible to claim the bonus prize, subject to compliance with and verification of all requirements of these official rules.
§ For example, if the winning 5-digit number is 1-2-3-4-5, then a driver’s license number of 5-5-5-1-2-3-4-6 would be a winning 4-digit match. (A driver’s license number of 5-5-5-6-1-2-3-4 would not be a winning 4- digit match.)
§ Released parties, including each individual contest administrator executing a contest attempt, are not responsible for any incorrect or mistaken announcement of the actual winning 5-digit number contained in the sealed contest envelope; or for any miscommunication between the contestant and the contest administrator regarding either the last 5-numeric digits of the contestant’s driver’s license number or the 5-digit winning number.
In order to claim the grand prize, the last 5-numeric digits of the contestant’s valid U.S. driver’s license number must match in exact order with the winning 5-digit number contained in the sealed envelope for that particular contest attempt, regardless of the number actually announced by the contest administrator. By participating, all contestants acknowledge and agree that their contest attempt and all communication with the contest administrator will be recorded in its entirety.
Prize Claim Procedures: In the event of a grand prize claim, the contestant will be required to produce sufficient personal identification along with their valid U.S. driver’s license at the sponsor’s business offices before the close of business on the following business day. Identification must include the contestant’s valid U.S. driver’s license and social security number. The name, address and
number on the contestant’s driver’s license number must exactly matches the information provided by the contestant during their contest attempt, and the last 5 numeric digits must exactly match in order with the winning 5-digit number for their corresponding contest attempt. Any driver’s license produced by a contestant that is fraudulent, forged, altered, tampered with in any manner, damage, or destroyed; or if the information on the driver’s license does not match the information provided or the winning number for the contest attempt, then all claims by that contestant are void. Failure to produce the required documents by the close of business on the following business day will result in forfeiture of the grand prize.
Prize Awards & Delivery:
Grand Prize: In the event that an eligible contestant has a valid U.S. driver’s license and the last 5-numeric digits of the driver’s license number match in exact order with the winning 5-digit number contained in the sealed envelope for their particular contest attempt, then that contestant will be eligible to claim the grand prize, subject to verification and approval. The grand prize is:
$1,000,000 40-Year Annuity. If awarded, grand prize will be payable in (40) equal annual installments of $25,000 Cash, without interest, on or about the anniversary date of the winning attempt. The first installment will be awarded approximately 2 to 4 weeks following verification and approval of all required contest information.
Amaximum of one (1) grand prize will be awarded during the contest, to the first eligible contestant to complete the prize winning requirements. In the event that no eligible contestant successfully completes the prize winning requirements, then the grand prize will not be awarded.
Bonus Prize: In the event that an eligible contestant has a valid U.S. driver’s license and the first 4-digits of the winning number contained in the sealed envelope for their particular contest attempt match in order with the numbers the contestant is required to match on their driver’s license, then that contestant will be eligible to claim the 4-digit match bonus prize, subject to verification and approval. The 4-digit match bonus prize is: $100,000 cash.
Amaximum of one (1) bonus prize will be awarded during the contest, to the first eligible contestant to complete the prize winning requirements. In the event that no eligible contestant successfully completes the prize winning requirements, then the bonus prize will not be awarded.
All prize claims are subject to verification, approval and compliance with these official contest rules, prior to prize being awarded. Prize winner(s), if any, must accept delivery of prize from sponsor, or as otherwise instructed by sponsor. All other costs related to prize delivery and acceptance is the responsibility of winner including but not limited to federal, state and local taxes. Prizes
are non-transferable and no cash redemption or prize substitution allowed, except at sponsor’s sole discretion or as provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable. Other restrictions may apply. All properly claimed prizes will be awarded. Any unclaimed prizes will not be awarded, except as provided herein.
All prize winner(s) will be required to complete and return aW-9 form (if prize value exceeds $600.00), affidavit of eligibility, and liability/publicity release (Tennessee residents need not sign publicity release), and present a valid driver’s license and social security card before prize will be awarded. Winners of prizes greater than $600.00 will be issued a 1099 form reflecting the value of the prize(s) and are responsible for paying all income taxes on prize(s). Failure to collect or properly claim any prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, contestant will not receive any other prize substitution or compensation. Total ARV of all prizes: $1,000,000 40 year annuity and $100,000 cash.
Additional Rules & Restrictions: By participating in this contest, entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor and Contest Administrator(s), which shall be final and binding in all matters relating to this Contest. In the event an entrant wins a prize, and is later found to be in violation of these rules he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after winner has used the prize. Participation in Contest constitutes permission for Sponsor and its designees to use entrants’ names, cities and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter devised worldwide without limitation or further compensation, notification or permission, unless prohibited by law. False, fraudulent or deceptive entries or acts shall render entrants ineligible for any prize. Entrants agree to hold Released Parties harmless from any claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to entrant’s participation in this Contest, or the acceptance, possession or use/misuse of any prize (including
any injury or harm resulting from use of the vehicle), or participation in prize-related activities (including but not limited to travel related thereto), and to assume all liability in connection therewith. Released Parties shall not be liable for mechanical, technical, printing, typographical, human, or other errors or malfunctions relating to or in connection with the Contest, including, without limitation, errors or malfunctions which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prizes, the conducting of the grand prize contest or in any Contest-related materials. If for any reason this Contest (or any portion thereof) is not capable of running as planned due to tampering, unauthorized intervention, fraud, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor and Administrator reserve the right, at their sole discretion, to cancel, terminate, modify or suspend the Contest (or any portion thereof). If terminated, Sponsor and/or Contest Administrator may, at their sole discretion, select the potential semi-finalist(s) or award prize(s) for the portion(s) at issue a random drawing from among all eligible, non-suspect entries received for such portion(s) up to time of such action. Sponsor and/or Contest Administrator also reserve the right, at their sole discretion, to disqualify any individual (and void his/her entry(ies)) who tampers with the entry process or who is in violation of these rules. Released Parties shall not be liable to winner or any other person for failure to supply the prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Released Parties’ sole control. No more than the advertised maximum number of prizes will be awarded for any reason.
IN CASE OF DISPUTES: By participating, each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of New Jersey; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, and in no event will entrant be entitled to receive attorneys' fees or other
legal costs; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-ofpocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New Jersey or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of New Jersey.
Odds: The odds of being selected as an official contestant to participate in the contest are dependent upon the number of calls received. The odds of an eligible contestant winning the grand prize once selected as an official contestant are 1:100,000. The odds of an eligible contestant winning the bonus prize once selected as an official contestant are 1:10,000.
